Terms and conditions

These terms and conditions ("Agreement") sets forth the general terms and conditions of your use of the homeport.navy.mil.nz website ("Website") and any of its related products and services (collectively, "Services"), such as the HomePort Application (“App”). This Agreement is legally binding between you ("User", "you" or "your") and the Royal New Zealand Navy ("RNZN", "we", "us" or "our"). By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and the RNZN, even though it is electronic and is not physically signed by you, and it governs your use of the Website and related Services.

Purpose of the App

The purpose of the Website and any of its related Services, including the App, is to provide users with unclassified useful information pertinent to their service in the RNZN or their interest in the organisation. 

Terms and conditions for using the App

A non-exclusive license is hereby granted to Users to install and/or use the HomePort software, data or documentation, subject to the terms and conditions below. Installing the software or using the data or documentation, as developed by the RNZN, shall indicate the user’s acceptance to enter into an agreement with the RNZN under this Agreement. If the user does not wish to be bound by this Agreement, any software, data or documentation installed shall be uninstalled and/or deleted immediately.

The RNZN grants the user a non-exclusive license to use the App subject to the terms and restrictions set forth in this Agreement. Installing the software or using related data or documentation shall indicate the user’s acceptance of this Agreement. The software, and all accompanying data and documentation are copyright, with all rights reserved to the RNZN. Subject to these rights, users may not copy, modify, sublicense, assign, pledge, delegate, convey, transfer, translate, convert to any programming language, format, decompile, reverse-engineer or disassemble the software, data or documentation, in whole or in part.

The information contained on the App is subject to change at any time and without warning. Notices of such changes may be promulgated using the notifications settings available on the App, however this cannot be guaranteed. RNZN users are reminded that guidance can always be sought through official NZDF and RNZN references and such references should be considered the authority should any conflicting information be found on this Website or any related Services.

In no event shall the RNZN be liable for any damages whatsoever in respect of any claim, action, demand or proceeding of any kind arising out of or related to the user's use of, or performance of, the software, data or documentation. Finally, the user agrees to indemnify the RNZN, against all liabilities and costs, including legal fees, of defending any action, claim, demand or proceeding of any kind by any person or entity alleging losses, damages, costs, injuries or expenses resulting from the use of this software, data or documentation.

Links to other resources

Although the Website and Services may link to other resources (such as websites, mobile applications, etc.), the RNZN is not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their resources. The RNZN does not assume any responsibility or liability for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other conditions of use of any resource which you access through a link on the Website and Services. Your linking to any other off-site resources is at your own risk.

Privacy Policy

You can use the Homeport App without disclosing any personal information to the New Zealand Defence Force (NZDF).

Statistical information

This App uses third party analytics and debugging tools, including FireBase, to help us make decisions about the operation of the app and to improve the content and functionality we provide through the app.

By using the app, you consent to the processing of data about your use of the app in the manner and for the purposes set out below.

The information generated about your use of the app  transmitted to, and stored by third party services, potentially on servers outside of New Zealand. This consists of statistical information about your use of the app, including:

  • your location in terms of country
  • your usage of the app, including the parts of the app you accessed
  • your operating system
  • other incidental matters such as screen resolution and the language setting of your browser.

RNZN and our app developers use this information to evaluate how the application is used to provide reporting and performance improvement services relating to app activity and usage. Firebase and other service providers may also transfer this information to third parties but only where required to do so by law, or where these third parties process the information on the service providers behalf.

Your IP address with any other data held for the purposes of analytics. NZDF cannot access your IP address details.

Other data

The NZDF will not collect any personal information from you unless you provide express consent (for example by registering within the app to access content reserved for registered user). If the NZDF collects any personal information it will be done in accordance with the Privacy Act 2020 and you will be informed of the purpose for which your personal information is being collected and how to exercise your right of access to that information.

Under the Privacy Act 2020 you have the right to access and to request correction of any of your personal information provided to the NZDF.

 

Sharing your information

The NZDF does not share any personal information provided by you to other government agencies, organisations or anyone else unless one of the following applies:

  • one of the reasons the NZDF was provided the personal information was to give it to a third party;
  • you have given authority to share the information with a third party;
  • it is required or authorised by the Privacy Act 2020 or by any other law, including, but not limited to, the following reasons:
  • to avoid prejudice to the maintenance of the law including prejudice to the prevention, detection, investigation, prosecution and punishment of offences
  • for enforcement of a law that imposes a pecuniary penalty;
  • for the protection of public revenue;
  • for the conduct of proceedings before any court or tribunal;
  • if it is reasonably believed that the use of the information will prevent or lessen a serious threat to public health or safety or to somebody's life or health; or
  • the information will be used in a way that will not identify you, or it is to be used for statistical or research purposes and will not be published in a way that will identify you.

How to access any personal information we hold about you

To view any personal information held by us, to request deletion of any personal information held by us, or if you have any concerns about personal information that we hold and wish to request its correction, you can:
